New Shareholders

Vogel Law Firm is proud to announce MacKenzie Hertz and Nick Surma as its newest shareholders for 2025. Both attorneys bring a wealth of experience, dedication, and leadership to our team, and we are excited to celebrate their achievements as they continue to serve our clients and community. 

MacKenzie Hertz
Based in our Fargo office, MacKenzie Hertz focuses her practice on employment law and litigation. She counsels employers on compliance with federal and state employment laws and regulatory requirements, providing practical and strategic advice on matters ranging from harassment claims to policy objectives.  As a skilled litigator, MacKenzie is also frequently called upon to defend employers in administrative proceedings and federal and state court.  MacKenzie is a qualified neutral under Rule 114 of the Minnesota General Rules of Practice, offering neutral internal investigations, as well as workplace training. 

Before joining Vogel Law Firm, MacKenzie served as a judicial clerk to a federal district judge in the United States District Court for the District of Nebraska and a federal appellate judge with the United States Court of Appeals for the Eighth Circuit, where she gained valuable insight into the federal court system.  MacKenzie graduated from the University of Nebraska College of Law with High Distinction, where she was elected to the Order of the Coif and Order of the Barristers, in recognition of her academic achievements.  Since joining Vogel Law Firm, MacKenzie has been continued to be recognized for her professional excellence, including being named a Great Plains Super Lawyers Rising Star in 2023 and 2024.  She also serves on the Section Council of the Minnesota State Bar Association’s Labor and Employment Section.  MacKenize is licensed to practice in North Dakota and Minnesota.

Nick Surma
Nick Surma, practicing in our Bismarck office, focuses his practice on construction law and commercial litigation. Nick is a skilled litigator who represents clients in a wide range of construction and commercial litigation matters including change order disputes, delay claims, construction and design defect, bond claims and liens, payment issues, breach of contract, negligence, and more. Nick also assists clients review, draft, and negotiate construction contracts and advises clients on the variety of issues that arise during complex construction projects. Recognized as a Great Plains Rising Star by Thomson/Reuters from 2022 to 2024, Nick is a respected advocate in his practice areas and an active member of the legal community. 

Before joining Vogel Law Firm, Nick served as a judicial law clerk for the Honorable Chief Justice Gerald W. VandeWalle of the North Dakota Supreme Court. A graduate of the University of North Dakota School of Law, Nick served as Managing Editor of the North Dakota Law Review and President of the Student Bar Association. His dedication and academic excellence earned him prestigious scholarships and honors during law school.
