Off-Highway Vehicle Collisions and Accidents

The Personal Injury Attorneys at the Vogel Law Firm have extensive experience in handling all off-highway vehicle (OHVs) collisions and accidents. All-terrain vehicles (ATVs) and utility-terrain vehicles (UTVs) such as four-wheelers, three wheelers, and side-by-sides, comprise the bulk of what is considered an off-highway vehicle. In our experience, when these vehicles are involved in an accident or collision, the results are usually catastrophic.
The United States Consumer Product Safety Commission (CPSC) has estimated that between 2016 through 2020, that there were 526,900 emergency department-treated injuries associated with OHVs in the United States and 2,448 deaths. Of this number, ATVs accounted for more than two-thirds of the deaths and nearly 300 of those deaths were among children under the age of 16. This has prompted the American Academy of Pediatrics to discourage kids and teens ages 16 or younger from driving or riding on ATVs.
Rollovers and collisions are the most common crash of causing broken arms and legs, dislocated hips, foot amputations and head injuries are the leading cause of death. Prior to sale, a distributor or dealership may modify the product’s seats, harnesses, or cage with aftermarket equipment that is designed to make the machine look “cool”, but doing so may eliminate or alter equipment designed by the manufacturer to keep the operator safe during a rollover. You should purchase this equipment only from a reputable dealer who has left the original safety equipment in its original condition.
To be safe, if you operate an ATV or UTV, remember to always wear goggles, long sleeves, long pants, over-the-ankle boots, gloves and DOT-compliant helmets. Never ride under the influence of alcohol or drugs.
